When there are name conflicts, you either take the name in a battle, make the guy change his name by convincing him to, or stop crying about it and move on. So battle him for names if its that much of an issue with you. You want the name, take it. There's no rule that says similar names can't exist, so technically, he can be whoever he wants. He wasn't intentionally trying to be you, and your name isn't that unique.
