I don't know the case well but a few things.. Many of the DA's in America and police are crooked as hell and work together to feed lies to the media as to get public opinion in the direction thats most beneficial for them. so there's no telling of the actual circumstances just the ones pushed forward by the state. Another thing in most of the states if you're gun Is not visible by 3 differnt views at the same time then u are illegally carrying a firearm regardless if it's urs or not n if u have a ccw (carry concealed weapon permit) u still have to let it be known before hand that u have a gun. So it might not matter who swung first.. They both followed ejother around, both thought the other we're up to no good, and then an altercation took place. One had a gun other didn't. If it was not known at the time of the altercation that the suspect had a gun the suspect should be facing manslauter at least because the victim never knew what he was getting into at that point. If it was racially motivated you wouldnt know with out checking into the suspects history but it doesnt change the charge it only adds an enhancement to the charge he is faced with.
