So if you rob a store with a gun, but in your head you had no intentions of shooting/killing.. is the penalty less? As opposed to someone who runs into a store with a gun, doesn't shoot anyone but has a killer mentality?

EDIT: And this is in no way me defending Anarchist, that was a fucking stupid what he did. Just trying to balance out the double standards here.
