If you are wanting to change your name and find out that some guy with like 3 battles and hasnt done anything since 2006 is using it, can that guy's name be over-ridden?

Oh I was just wondering, cause I was thinking of some names and most of them Had been taken by people that aren't active or have never done anything. If I decide on one I'll let someone know. I just wasn't sure about that rule
